Hearing Dates and Information Requests

I am keeping membership up to date on the scheduling of the upcoming District Hearing & Appeals Board hearing.  Membership had been denied hearings before the Election Board prior to rendering unilateral rulings without direct membership input which dramatically impacted our Chapter (in violation of Bylaws).  I am requesting that this matter be forwarded by 1199NW to SEIU International.

I am off today (Friday) and Monday because I am scheduled to cover the weekend.  I will not know if I am approved to have Wednesday, November 5, 2014 off until next week.  My work schedule ends at 3 PM daily, I could be in Renton by 4 PM.  This would allow my participation in a hearing on almost any day of the week.  Can a date be set where the hearing occurs on or after 4 PM?  I have not yet had opportunity to discuss this with Willie Saw.  Willie works evening shift thus there could be schedule issues should he wish to be present for the presentation before the Board.


This document serves as an official information request for the hearing.  Please provide the following information pertaining to the validity of the current District Hearing & Appeals Board and Election Board.  The information requested also pertains to the Chapter structure imposed upon WSH by the 1199NW Election Board.


  1. Provide a copy of all documents that pertain to the selection process (how members were selected for) the District Hearing & Appeals Board without a District Delegate Assembly nomination process.
  2. Provide a copy of 1199NW membership notification of open positions within the District Hearing & Appeals Board so that interested members may apply.
  3. Identify the 1199NW candidates for the District Hearing & Appeals Board (DHAB) prior to their placement on that Board.  Provide a copy of the petitions and any DHAB candidate documents that were presented to the Executive Board.
  4. Identify which Executive Board members voted to install the elected DHAB candidates.
  5. Identify the name of the current DHAB Chair and Secretary and copies of all documents pertaining to their election to those positions.
  6. Identify the name of the Chair of the Election Board.
  7. Identify the Employer of the Chair of the Election Board and the Chapter where the Chair pays 1199NW dues for.
  8. Identify the dates and times Western State Hospital Chapter members testified before the Election Board, pertaining to the original ruling of invalidation of the Western State Hospital election and the ruling pertaining to the Western State Hospital reelection.
  9. Explain why 1199NW (or 1199NW Election Board) prevented appellants from participating in an Election Board hearing in the original Election Board decision invalidating the Western State Hospital election and the subsequent reelection decision hearing.
  10. Provide a copy of all postings of Election Board hearing that were sent to membership pertaining to the Western State Hospital election invalidation hearing and reelection hearing.  
  11. Bylaws require that the DHAB members be elected to a two year term to prevent bias and intimidation.  Provide copies of all documents produced by 1199NW that indicate that 1199NW could forgo two year terms and make short term appointments to a DHAB.
  12. Identify all years that 1199NW has operated without a two year term elected DHAB by the District Delegate Assembly.  For all years where 1199NW claims a proper District Delegate Assembly elected a two year term DHAB, provide a copy of the documentation that would validate 1199NW’s claims. 
  13. 1199NW Organizers are employees of 1199NW and belong to their own Union which negotiates its own Collective Bargaining Agreement with 1199NW.  Identify the name of the 1199NW Organizer Union and provide a copy of the CBA.
  14. Chapter union operations include grievance processes, committee processes, labor/management meeting and other bargaining processes. Provide a breakdown of all current Chapter Officers used for all Chapters.  (Pertains to the chapter officer structure imposed upon WSH in the reelection process.)  
  15. Excluding WSH, identify the number of Chapters that have a “Chair” and a separate “Executive Board Member.”  
  16. Excluding WSH, identify the number of Chapters that have a Corresponding Secretary Chapter Officer position.
  17. Excluding WSH, identify the number of Chapters that have Executive Board Members with no Chair Chapter Officer position.
  18. Provide copies of all documents that 1199NW used to impose the reelection structure that was applied to Western State Hospital.
  19. Provide copies of all documents pertaining to the election of the Election Board at the last District Delegate Assembly. This would include a list of all candidates and vote counts.
  20. Identify all years that 1199NW has operated without an Election Board that was elected at a District Delegate Assembly.  For all years where 1199NW claims a proper District Delegate Assembly elected an Election Board, provide a copy of the documentation that would validate 1199NW’s claims.
  21. Identify the role of Paul Drachler in the original Election Board and DHAB hearings and the subsequent reelection Election Board hearing and DHAB Hearing.
  22. Provide a copy of all documentation identifying the role of the Chair and Secretary of DHAB.
  23. Provide a copy of all documentation identifying the role of the Chair of the Election Board.

Time is of the essence with regard to this request for information.  If it is proven that the current DHAB and Election Board were not properly elected by the District Delegate Assembly for terms that are required under the Bylaws…  I petition for 1199NW to forward the hearings to occur before SEIU International.

The District Hearing and Appeals Board (DHAB) hearing on your appeal of the Decision of the Election Board on Objection to the Conduct of the Western State Hospital Election and Complaint is tentatively set for Wednesday, November 5, 2014, 2:30 p.m. at the Union office located at 15 S. Grady Way #200, Renton, WA 98057.

 

This is only a tentative date, and is subject to change. Once the hearing date is finalized, a formal notice of hearing will be issued.
